1. Waco police wrap up investigation at site of biker gang shootout

Waco police announced they intend to finish their crime scene investigation Tuesday at the site of a battle between rival biker gangs that left nine dead Sunday. Some of the victims in the fight may have been shot by police officers who exchanged fire with the bikers, but Sgt. W. Patrick Swanton cautioned that the details of who killed whom can't be confirmed until the autopsies are concluded. So far, more than 170 suspects have been arrested and charged with engaging in organized crime, a capital offense that could bring the death penalty in Texas.

2. And the fittest city in the USA is...

Believe it or not, Washington, D.C. was ranked the most fit city in America in the eighth annual American Fitness Index from the American Council of Sports Medicine and the Anthem Foundation, which was released Tuesday. No, it's not all the people constantly running for office that keep the nation's capital so healthy, but rather the abundant access to parks and paths for jogging, walking and biking that keep it fit. Indianapolis ranked last out of the largest 50 cities in the U.S. according to the study, which is based on outdoor exercise options and rates of smoking, obesity and diabetes.

3. 56 years later, 'Shawshank' fugitive heads back to Ohio

The 79-year-old fugitive who escaped from an Ohio prison work camp nearly six decades ago is set to return to the state to face charges. Frank Freshwaters was 21 years old when he was indicted on second-degree manslaughter charges in the death of 24-year-old Eugene Flynt in front of his home. He was sent to Ohio Reformatory, the prison featured in the 1994 movie The Shawshank Redemption, after authorities said he violated his probation. Freshwaters had no further record of any legal trouble, said Maj. Tod Goodyear of the Brevard County Sheriff's Office, and friends say he lived a quiet life, volunteering occasionally for a local church and growing old with a wife who died of cancer in the 1990s.

4. Fatal crash raises concern about Osprey MV-22 safety ahead of demonstration

The fatal crash of the Marine Corps' new hybridized airplane-and-helicopter aircraft, the Osprey MV-22, that killed one Marine and critically injured another during a training exercise in Hawaii over the weekend, is renewing safety concerns about the machine. The Osprey program was nearly scrapped after a history of mechanical failures and two test crashes that killed 23 Marines in 2000. But the Marines say the MV-22 Osprey has proven itself to be very safe despite high-profile accidents early in its operation and the aircraft will participate in a demonstration of an amphibious landing for a symposium involving defense leaders from 23 nations at Bellows Air Force Station on Tuesday.

5. NBA draft lottery full of risk and intrigue

Since the NBA began using a lottery-style system in 1985 to determine its draft order, the team that finished the season with the worst record has won the top pick just four times. This year there's added intrigue because the Knicks and Lakers are in the lottery, with particular attention on the Lakers. With the fourth-worst overall record, the Lakers can pick no worse than seventh, but the pick is top-five protected, meaning if it's pick 1-5, the Lakers keep it. But if they fall to sixth or seventh, it goes to the Philadelphia 76ers. There's a 17% chance that happens. Confused? Just wait til you try and figure out how the ping-pong balls work.
