New York Attorney General's Office opens investigation into Marcy inmate's death


The New York Attorney General’s Office of Special Investigations has opened an investigation into the death of Marcy Correctional Facility inmate Robert Brooks.

According to the Attorney General’s Office, Brooks died on Dec. 10 following an “...encounter with New York State Department of Corrections and Community Supervision officers” on Dec. 9.

Brooks was a resident of Greece in Monroe County and was incarcerated at Marcy Correctional Facility after stabbing his then-girlfriend multiple times during a physical dispute. He pleaded guilty to first-degree assault and was sentenced to 12 years in prison, which started in 2017.

According to the Attorney General’s Office, following the use of force by correction officers, he was transported to a local hospital and pronounced dead in the early morning hours of Dec. 10.

“Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission,” the Attorney General’s Office wrote in a statement. “Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident.”
