No charges to be filed in alleged rape at home of Nebraska football players
Authorities concluded their investigation of the alleged rape that took place in the home Nebraska quarterback Tommy Armstrong and receiver Jordan Westerkamp and no charges will be filed, police and the district attorney said in a joint news conference Wednesday.
Armstrong and Westerkamp were among six people home – including tight end Trey Foster – in the early morning hours of the Nov. 15 alleged incident reported by a 20-year-old woman.
"We will not be filing charges in regards to this investigation," Lancaster County Attorney Joe Kelly said. "Filing it would require proof upon a reasonable doubt that a crime had occurred. That simply is not there."
Lincoln Police Chief Jim Peschong wouldn't comment on whether alcohol was a factor.
Kelly said forensic evidence "wasn't an issue" because authorities knew who was in the house at the time of the alleged incident.
A rape kit was conducted.
