Cowboys' Ezekiel Elliott, NFLPA expect appeal decision Tuesday as they fight NFL's legal response
NFL-appointed arbitrator Harold Henderson has informed Ezekiel Elliott’s representatives that he will issue a decision on the Dallas Cowboys star's appeal of his six-game suspension Tuesday, according to a legal brief filed by the NFL Players Association on Elliott’s behalf Tuesday afternoon.
The brief was in response to a pair of filings made the by league Monday night. The NFL is seeking to dismiss Elliott’s request for a temporary restraining order of his suspension.
Henderson heard Elliott’s appeal over the course of three days last week. Elliott wants his suspension vacated entirely. But if it's upheld, he'll have to hope a Texas court will provide an injunction which will allow him to play, starting with Sunday night’s regular-season opener, while he wages a legal battle with the NFL.
The league argued that the NFLPA does not have the legal standing to challenge the suspension in court. A hearing is currently scheduled for Tuesday at 6 p.m. ET in Dallas.
In the eight-page response filed by the union Tuesday afternoon, Elliott’s lawyers wrote that they would show at that hearing that Elliott’s case “meets the four elements for preliminary injunctive relief.”
“Injunctions are issued when the bulldozer is on the front lawn — not after it has razed the house,” NFLPA lawyer Jeffery Kessler wrote in the brief.
